Join WHF for a program on the NYDFS Cybersecurity Regulations. Lunch will be provided, courtesy of Ballard Spahr.

Program Description: The New York Department of Financial Services (NYDFS) cybersecurity regulations took effect on March 1, 2017.  The regulations require financial institutions to establish and maintain a cybersecurity program meeting "certain regulatory minimum standards."

Banks, state-licensed lenders, mortgage industry companies, insurance companies, money services businesses, and all other financial institutions subject to NYDFS jurisdiction should carefully assess whether their existing security measures will need to be enhanced and what additional steps may need to be taken to satisfy the requirements. Third-party service providers to these institutions should also prepare for compliance requirements that will likely be imposed downstream from these covered entities. In this program, we will discuss the implications of the NYDFS regulations for covered entities.

Topics will include:

  •     What the regulations require
  •     The timeline for compliance with various requirements
  •     How financial institutions should prepare for the new regulations

Speakers: Kim Phan, Of Counsel, Ballard Spahr and Wendy Tran Novotne, Associate, Ballard Spahr

Kim Phan

Kim Phan is Of Counsel in Ballard Spahr's Privacy and Data Security Practice Group.  She counsels financial institutions on a wide range of federal and state privacy and data security statutes and regulations, including GLBA, FCRA, TCPA, and UDAP/UDAAP. Her work in this area encompasses strategic planning and guidance for companies to incorporate privacy and data security considerations throughout product development, marketing, and implementation. Kim also assists companies with data breach prevention and response, including establishing effective data security programs prior to a breach and the assessment of breach response obligations following a breach.  Kim has also done extensive e-commerce and mobile counseling with clients, including online behavioral advertising and social media.  Kim also assists clients to navigate responding to governmental investigations by congressional committees and agencies such as the CFPB, FTC, and state attorneys general.

Wendy Tran Novotne

Wendy T. Novotne is an associate at Ballard Spahr.  Her practice focuses on consumer financial services, privacy and data security, and mortgage banking.  Before joining Ballard Spahr, she worked in-house at one the nation’s largest private mortgage companies where she worked on regulatory compliance, consumer protection, data protection and privacy, and marketing matters.
